The Cascade Woodlands Land Owners Association (CWLOA), over the last four years, has failed to address many important issues to include re-establishing a community asset/resource that is listed on deeds and advertisements for our community. This lost resource and lack of attention to re-establishing it affect the value of each property within the association.
The CWLOA has also failed to effectively enforce the rules to include ensuring that the Bylaws are followed with regards to out-of-compliance lots. The CWLOA has also targeted specific groups of people while allowing others to slip by. The CLWOA continues to discount the importance of representing the entire community equally.
Last year, the President, Vice President, Secretary, and Treasurer all resigned in a fit. This left three board members, and one was removed due to petty personal reasons. A recent election was held with resigned members running the election. One Board member was actively manipulating the election and coercing Proxy Votes from residents. This board member, along with the resigned secretary and treasurer, hand-selected a preferred slate of candidates. One selected resident/board member has a lot that is so out of compliance with junk vehicles, dilapidated structures, and rotting trailers it is comical.
After the election was “completed”, a group of residents requested access to review records as allowed in the Bylaws. The board refused to give access, which required a lawyer to be hired to demand access to documents. The CWLOA wasted community resources hiring a lawyer of their own to tell them that yes, they did indeed need to follow the rules they were “elected” to enforce. They also have refused to respond to legitimate requests for information, have been conducting impromptu work parties, and excluding community members that wish to participate. The Corporate officers have not been updated properly per the secretary of state, and the current board is jeopardizing the very legality of the operational authority.
We have repeatedly requested that the Board stop violating privacy laws by sending community-wide emails with everyone’s email addresses exposed. The new president has communicated with residents in a derogatory and dismissive manner over public emails. Additionally, he has named a specific group with a nasty moniker in an attempt to shame those members. One of the board members has actually committed libel by calling a resident a liar in a community-wide email. Another of the board members has made threats to include racist remarks as well as physical threats.
A group of residents representing well over 33% of the community population has requested repeatedly that the Board resign and re-run the election. One resident has been methodically documenting this situation for several years and has assembled a detailed outline of the stated issues in this message. Upon final receipt of the documents requested, after a legal demand letter was presented, it was discovered that several failures occurred during the election.
After bringing these issues to the attention of the board, no response has been provided, and after allowing for a reasonable time to respond, we, as a group, have decided our last option is to file a complaint with the AG. Our goal has been to have a fair and equitable board that represents the entire community. Their dismissive attitude and inconsistent performance and enforcement have brought us to this point.
All of the mentioned items as well as many more have been carefully stored and are available in digital format. A significant group of residents has requested a new election based on the statements listed above. We would request that the AG perform an investigation, and assist us in restoring our CWLOA to be a fair and equitable organization for this entire community.
Finally, we have requested to be reimbursed for the expense of our lawyer. This expense was unnecessary as the rules of the disclosure are simply defined in our bylaws. The board has refused a response o this request, and now we must file a small claims action to recover these expenses. This decision by the board is going to cost the CLWOA additional unnecessary expenses due to ego and pride.
The board continually illustrates unprofessional and incompetent management practices. Within the community and the significant group of members opposing the current board, there are several real estate management professionals willing to step in and manage the CWLOA properly and legally.
