Poll results, Records, Surveyors and removal of board member

The most recent mailing to the residents of the CWLOA included a poll with four questions and a return envelope. Three weeks have passed since the mailing and a total of sixteen 10-15-2022 POLL Results responses were received back through the USPS mail system. Several individuals placed some personal notes on the 10-15-2022 POLL Results sheets which will be taken into consideration. On October 15, the poll responses 10-15-2022 POLL Results have been tallied and the responses are as follows:

Based on the numbers, the board has taken an administrative vote on two matters. The first subject is related to acting on the issue at the river, with all members of the board, minus Steve Lee Jr.,  voting in favor to expend the dollars necessary to mark the corners of the property lines related to the two parcels that are affecting the access to the river.

The second issue voted upon was to remove Steve Lee Jr. from the board due to lack of participation. By removing him from the board, he can now be served with legal process documents along with the remainder of the board members whom are legally responsible for maintaining and transferring corporate records in the State of Washington. The previous board has been repeatedly asked to turn over the documents of the corporation. On October 4, 2022, Martin Sederberg spoke to Steve Lee Jr. at the gate and asked specifically if he would be providing the records. Steve Lee Jr. Verbally stated he would deliver them. The board agreed to give him some time to produce these materials, and he has failed to do so.

 

 

 

 

 

 

Based on the repeated requests for records, ample time given, and legal requirements, the board has administratively voted to retain an attorney and start the legal process to obtain these records. This cost is being incurred due to the lack of performance by previous board members.

 

 

 

 

 

 

 

The CWLOA board will be contracting with a surveyor to set the markers of the property corners that affect the easement to the river for community access. Additionally, the survey will identify the center line of the existing roadway so that should a flood event affect the roadway, it can be restored as necessary. This expenditure will fall under the allowable amount the board is authorized to spend. An attempt was made to negotiate an amicable solution with the property owner prior to this step with no success.

The board will be scheduling a general special meeting and notifying all members of the location, time and agenda. The board will prepare ballots to physically vote on several items in person. The primary topics of discussion and vote at the meeting shall be:

Amend and update bylaws

Allot funds for gate replacement

Allot funds for legal process to resolve river access issues
